The use of The Ivory Suite, LLC web site(s) is governed by the policies, terms and conditions set forth below. Your use of this site, viewing, or any other The Ivory Suite, LLC web sites, placement of order, subscription to any of our sources or any other indicates your acceptance of all of our stores sales terms, policies, terms and conditions. By ordering, purchasing or other from us you expressly agree to the Conditions, Policies, Sales Terms and Other Agreements as set forth on this page and other pages. Therefore, please check these terms and conditions carefully each time you place an order with, or accept delivery of any goods from The Ivory Suite, LLC. This is a Legal & Binding Sales Agreement for our Web Sites.
The following Terms of Use ("Terms"), Sales Terms, Policies, Agreements, Use and other may be updated or revised by The Ivory Suite, LLC from time to time. The Ivory Suite, LLC may not provide notice of materially significant changes or other changes to the Sales Terms, Return Policies, Agreements or other on any of its web site(s). You still agree to be held personally liable, responsible and accountable for any monies owed, debts, interest and all collection costs.
PAYMENT
1.1 Method of Payment
Payment is only accepted in the form of US Credit Cards. Payment by verified US Credit Cards with matching addresses verification through our authorization center (USA Sales Only). Card Holders Billing Addresses are verified via secure 128 bit encrypted online merchant gateway in the same way as any standard retail store. Not providing the proper billing address will automatically decline your order when we actually process it. We use the latest secure online verification process and do not call banks.
1.2 Additional Credit Card Charges
If necessary, The Customer/Buyer authorizes The Ivory Suite, LLC to add additional charges or new charges to their credit card to process your order or to collect unpaid debts, interest, collection costs, attorneys fee's or any other reason such as: 10% restocking fee on returns or exchanges, additional charges for shipping and refusals, additional charges for non-deliverable for any reason, additional charges for upgrading the shipping method.
1.3 Sales Tax
As required by California State Law, sales tax of 9.75% must be charged on all orders shipped within California state. Orders shipped to addresses outside of California state will not be charged any sales tax.
SALES TERMS
2.1 Returns
Items may be returned, excluding shipping costs, but must be postmarked no later than 7 days after you receive the shipment. Since we track all of our shipments, we adhere strictly to this policy due to the nature of our business. There is a 10% restocking fee for all items returned. All Items must be returned with original tags attached, unused and in their original packaging and condition. You must email us at theivorysuite@gmail.com for a return authorization number and the reason for your return. We unfortunately cannot assist you with this over the phone. Packages without a vaild return authorization number, or postmarked later than 7 days after receipt will be refused.
All sale items and/or items ordered from our Sale section are not returnable. Special and custom order items (including dyed shoes) are not returnable. When you place an order with us, orders are processed in real time and we cannot accept any changes or cancellations.
2.2 Exchanges
Items may be exchanged, excluding shipping costs, but must be postmarked no later than 7 days after you receive the shipment. All Items must be returned to us with original tags attached, unused and in their original packaging and condition. You must email us at theivorysuite@gmail.com for an exchange authorization number and the reason for your exchange. We unfortunately cannot assist you with this over the phone. 2.3 Exchange/Return Process
You must contact us to via email at theivorysuite@gmail.com to receive an return/exchange authorization number. Your items must include the original Packing Slip or Receipt, and be postmarked no later than 7 days of receipt of your shipment. All items must have all orignal tags attached, and be unused in original packaging. Packages and items not meeting these requirements will be refused or not considered for any type of return or exchange. There is an automatic 10% restocking fee that will be charged to your credit card on file for all returns. There will be no shipping and handling refunds on any order.
2.4 Proof of Purchase or Receipt Required
The original Packing Slip or Receipt is required by the customer for any and all returns and exchanges. This is the only acceptable Proof of Purchase we will accept.
2.5 Damaged and Defective Merchandise
We very carefully inspect, pack and ship each item. The decision on whether an item is damaged or defective is to be determined by us. If you receive damaged or defective merchandise, we ask that you take a digital photograph of the item and email it to us so we can expedite the exchange process. You must contact us within 2 days of receipt of the shipment. If you received a damaged item due to shipping, please save the box and we will file a claim with the carrier. Please note that a claim can only be filed if you have the original packaging. We do not issue refunds for damaged shipments unless we cannot replace the item.
2.6 Return/Exchange Authorization
No returns or exchanges will be accepted without a return/exchange authorization number from us. Once you receive a return/exchange authorization number from us, we will also provide you very specific instructions for the return/exchange process. All returns/exchanges must have the exchange authorization number clearly printed on the outside of the package, Attn: Exchange Department.
2.7 Merchandise Inspection
All returned and exchanged merchandise will be inspected to insure that the above-mentioned requirements are met. Any merchandise that is received with missing parts or tags, used, not in original condition, or is damaged and not in a re-sellable condition will be refused, and may be discarded or sent back to the customer at their expense. We reserve the right to refuse a return on any product that does not meet the above requirements or for any other reason.
2.8 Shipping Returns
There will be no shipping and handling refunds on any order. For your security, please return your items with an insured courier (e.g., FedEx, UPS, USPS Mail) with insurance and a Tracking Number, and retain your receipt. We are not responsible for items damaged or lost in transit.
ORDERS
3.1 Processing
Online orders will only be processed and fulfilled through this website. We only accept special or custom orders through fax, email, or telephone. All orders are processed in real-time, and cannot be changed or canceled. Special and custom order items are final sale, and cannot be returned or exchanged. Buyer agrees and understands that he/she is entering in to a legally binding sale.
3.2 Checkout
Please follow the easy checkout instructions on the checkout pages. Review your order carefully before checking out. The Ivory Suite, LLC is not responsible for any customer checkout errors, ordering errors, or incorrectly entered information. This will include any and all ordering information, compatibility issues, etc.
3.4 Fulfillment
The Ivory Suite, LLC reserves the right to accept, refuse, or limit your order for any reason, including, but not limited to, credit review, the unavailability of a product or errors in the prices and product descriptions posted on our web site(s).
3.5 Product Availability
Many products are in stock. If the product you have ordered is unavailable or backordered, we will contact you regarding your order. If the item is no longer available, you will be asked to accept a similar item. We cannot guarantee that there will be similar items available, but we will work to find something else that you can enjoy. If you upgrade your shipping, we will add any rush fees to your order as necessary.
SHIPPING
4.1 Methods and Delivery Time
We ship via UPS, FedEx or USPS Mail. We do not ship outside of the United States.
Please allow up to 3-4 weeks to receive your order placed with standard shipping unless otherwise stated. If you decide that you need some of your items sooner, please upgrade to rush shipping. PLEASE NOTE: Choosing Express Shipping does not decrease the time the item(s) are available to ship, or the time to process your order. We cannot guarantee the exact time and date for the arrival of your order. We are not responsible for special shipping requests (ie. Leave at front door, etc.) You must be available on the date that the package is delivered to sign for it, or to accept the package.
4.2 Multiple Shipments
Some orders that are shipped from the manufacturers across the country may require longer for the item to ship. We may also ship the orders with multiple items from different locations, so it is possible you get the items on different days and in more than 1 package.
4.3 Address
Please make sure you have entered all your information correctly during checkout. The Ivory Suite, LLC is not responsible for delivery to the wrong address, and for your errors and mistakes. You are responsible for all charges incurred for re-delivery.
4.4 Damage
The Ivory Suite, LLC is not responsible for any damage done to the product(s) after leaving our warehouse. We put all items through an inspection process before packaging, and comply with standard packing techniques to insure a safe delivery. Sometimes, packages are damaged in the shipment, and are the responsibility of the delivery service. Any and all disputes regarding damaged items should be expressed to The Ivory Suite, LLC within 2 days of receiving product. If a Customer has disposed of the original packaging of the item(s) or does not have the complete original packaging, The Ivory Suite, LLC will not be able to file a complaint with the delivery service, and cannot issue an exchange.
4.5 Lost or Stolen Items
The Ivory Suite, LLC will not be held liable for any lost or stolen items once the item(s) have left and shipped from our premises. There will be no shipping and handling refunds on any order. The Ivory Suite, LLC is not liable for any action by the shipper, company or carrier. By ordering from us this is a legal agreement. Please contact the shipper directly for any loss, damage, non-receipt of goods or any other delivery problem.
4.6 Shipper Company or Carrier
The Ivory Suite, LLC is not responsible for any shipment time or delay. You agree that any shipping problems including but not limited to; non-delivery, delays, late delivery, wrong delivery, unclaimed, error and all other delivery issues will be the liability of the shipping carrier and not The Ivory Suite, LLC. You further agree you will not attempt to stop payment to The Ivory Suite, LLC because of any shipping problem, incident, delay, non-delivery or any other delivery issue. Please directly contact the shipper for any and all issues. Once we secure a tracking or delivery confirmation number showing that the order was labeled, shipped and has left our premises, any and all liability and responsibility is on the shipper, not us.
4.7 Shipping Charges
Shipping and handling charges are not refundable or creditable on any occasions. Adjustments in shipping and handling costs may be added when your order is packed and shipped or on other incidents, including redirecting package(s) to another location, you authorize us to charge your credit card as needed if required at anytime.
4.8 Non-Deliverables
All refused, unclaimed, re-directed, non-deliverable orders and all other unauthorized returned packages, return to sender will be discarded and you will not be refunded or credited back. Please try to avoid this issue by being prepared to accept delivery of the order you placed. By submitting your order you are entering a legal and binding agreement to a sale by our terms.
COMMUNICATION
5.1 Contacting Us
Emailing us at theivorysuite@gmail.com is the most reliable way of contact. Be sure to have your 3-digit order number available to ensure that we can find your order in our system.
5.2 Contacting You
We use email and telephone as our primary source to contact customers, we email all order confirmations, invoices, shipping and tracking information to the customer. Please note that it is important you give us the proper phone number, email address information, have us on a "white list" to receive emails, use virus protection, have room in your email box to receive new emails (be sure to check your SPAM Box or Bulk Box). Please be sure to type in your email address and phone number correctly. We cannot be responsible for your errors or mistakes. If we try to contact you multiple times and cannot reach you because the phone number or email address you gave us is incorrect, we are not responsible for getting the items to you. We will contact you if there is a question about a particular item, or a concern about the timeline.
5.7. Opt-Out
On occasion, we will email you a promotion, special, or discount we are currently offering on our web sites. If you would like to opt-out of these promotional emails, please reply to the email with the word “REMOVE” on the subject line. Please allow up to 10 days for the opt-out to take effect. You cannot opt-out of transactional emails and receiving communications from The Ivory Suite, LLC (or third parties who may assist us) relating to your order(s) or request for a product or service.

In the event that The Ivory Suite, LLC is unable to provide an actual image of a particular product, The Ivory Suite, LLC reserves the right to substitute a similar picture or image of that product. The size charts shown are provided only as a guide by the manufacturer. We cannot be responsible for inaccurate sizing. We recommend that you compare your body measurements to the size guides on each garment page prior to placing an order.
FRAUD
7.1 Authorization
All the Information you provide must match the valid credit card account records as provided by the issuing bank or other 100%. You must be the actual listed holder, provide full name, full address and the phone number actually listed with the bank. Providing false information constitutes fraud and will not be tolerated and you will not be refunded on any occasion for any matter. Fraudulent behavior will be aggressively prosecuted by us and authorities to the fullest extent of the law.
7.2 Credit Card Fraud
If your card was used illegally and an order was placed with us, you must contact the credit card company and your local police to file a report immediately. Anyone who uses a credit card account without authorization, or who disputes a charge for products or merchandise for which they have placed an order and took delivery, is committing credit card fraud, a felony, and will be prosecuted to the fullest extent of the law. We take credit card fraud and all other types of fraud seriously and may report, seek actions, seek penalties and fines, investigate and prosecute any persons who are involved in such activity. All fraud orders or attempts may be reported to the FBI, FTC, and local law enforcement authorities for investigation / prosecution and other. Our privacy policy or other policies may be null and void for all criminal or non-criminal acts or attempts and all information shared with the authorities.
7.4 Disputes
Non-Payment, Reversal of Charge Backs, Credit Card Charge Backs, disputes, inquiry's or other reverse or no payment method may be Treated as Fraud, Reported to Authorities and may be sent to a Collections, Attorneys and Credit Bureau's. You will also be liable for all incurred costs involved with collecting any payments or balances due. Be advised if you breach our agreement/terms/policies we will pursue you to the full extent of civil and criminal law. Be sure to contact us if you have a problem, this is your full responsibility. Failure to contact us and make contact will breach your agreement and you will be legally liable for all debts incurred.

If you attempt to scam or defraud us in any way, you will be prosecuted to the fullest extent of the law as well as face possible civil court actions. Federal laws will also be applied to any criminal attempts or actions.
